The regular meeting of the State Board of Examiners was called to order at 204 N. 8th Street, Boise, Idaho, at 8:00 a.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following board members were present, constituting all the members: Governor Dirk Kempthorne, chairman of the board; Secretary of State Ben Ysursa; and Attorney General Lawrence Wasden.

State Controller Keith Johnson, secretary to the board, recorded the proceedings of the meeting.


CONSENT AGENDA

Mr. Johnson introduced the items on the consent agenda. Mr. Wasden moved to approve the consent agenda as recommended in its entirety; Mr. Ysursa seconded the motion. The motion carried by unanimous voice vote.

1. Minutes – Approved

    Approval of official minutes for the meeting of the Board of Examiners on February 14, 2006.

    Request for recognition of assignment pursuant to Idaho Code §67-1027 from Hillcrest Shopping Center, LLC to FPA Hillcrest Associates, LLC.

3. State Treasurer’s Office – Approved

    Request for approval to issue the Fiscal Year 2007 Tax Anticipation Notes.

    Audience with the Board: Ron Crane asked permission to issue tax anticipation notes for the fiscal year 2007. Mr. Crane said estimated revenues for the state will be $2,256,100,000.00. Mr. Crane said the code authorizes up to 75% of that amount for issuing tax anticipation notes, but that amount will not be issued.

    Discussion: Dirk Kempthorne asked the state treasurer how it will be when he meets with bond agencies in New York knowing that Idaho has a 3.3% unemployment rate, its structural imbalance has been wiped out, and it is closing this fiscal year with a positive balance.

    Mr. Crane said it will be a good story to tell. Mr. Crane said the fact that Idaho has a significant amount of money in the rainy day fund, the economy is doing very well, and its shadow rating was raised in the last year from a AA3 to AA2, and is just three notches from a AAA without any guarantee, makes it a pretty good time for Idaho.

    Resolution: Mr. Ysursa moved to approve the Regular Agenda. Mr. Wasden seconded the motion. The motion carried on a unanimous voice vote.

    Notification of closure of rotary fund 0803 for the Department of Administration effective March 1, 2006.

    Notification that the State Department of Education granted permission according to Idaho Code §59-512 for Jana Jones, Chief Deputy Superintendent, to teach an Intermediate Statistics in Educational Research at Boise State University.

Notification that Hollis Mercer, Attorney at Law, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in Dutton v. b. Notification that Joel M. Wasden, in his official capacity as Attorney General of the State of Idaho in Cutting Edge Enter., Inc. v. The Nat’l Assoc. of Attorneys General, et al., S.D.N.Y. Civil Action No. 06 CV 667 (GBD).
c. Notification that Canyon County Prosecuting Attorney David L. Young, and Deputy Prosecuting Attorneys Charles L. Saari and Scott D. Spears, have been appointed for the purpose of representing the Honorable Ronald J. Wilper in U.S. Amateur Boxing Fed’n et al. v. Wilper, et al., Idaho Supreme Court Docket No. 32553.
d. Notification that Mitchell W. Brown of the firm of Racine, Olson, Nye, Budge & Bailey, Chtd., has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of reviewing applicable law and Department policies on wildlife crossing state highways for the Idaho Transportation Department.
e. Notification that Anne Goodwin Crump of the firm of Fletcher, Heald & Hildreth in Arlington, Virginia has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of providing counsel and representation to Idaho Public Television with regard to matters before or related to the Federal Communications Commission. This appointment will expire on February 21, 2007, or at such earlier date as determined by this office.
f.
