STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
March 15, 2016 – 8:55 a.m.
Boise City Council Chambers, Boise City Hall,
3rd Floor, 150 N. Capitol Blvd., Boise

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.

The following board members were present: Governor C. L. “Butch” Otter, Secretary of State Lawerence Denney, and Attorney General Lawrence Wasden. State Controller Brandon Woolf recorded the proceedings of the meeting.

Controller Woolf stated that his office received a request to add an item to the agenda after the posting of notice deadline. The agenda will need to be amended to include the item.

Mr. Wasden moved to include item 7.b. for the bill amount to the agenda. Mr. Denney seconded the motion.

Governor Otter asked if this meets the required time.

The board members went at ease.

Mr. Wasden commented that they can amend the agenda at the time of the meeting based on a good faith reason. Adding the cost bill, which was received March 14th at 2:55 p.m., would fall under this rule.

The motion carried on a unanimous voice vote.

Mr. Woolf introduced the consent agenda items.
Attorney General Wasden moved to approve the consent agenda. Secretary of State Denney seconded the motion. The motion passed on a unanimous voice vote.

    3. Department of Environmental Quality – Approved
    a. Request in accordance with Senate Bill 1163, that $133,000.00 be transferred from the Air Quality Permitting Fund #0186 to the Department of Environmental Quality Fund #0225 during the fourth quarter of Fiscal Year 2016.

    b. Request in accordance with Senate Bill 1163, that $319,600.00 be transferred from the Public Water System Supervision Fund #0191 to the Department of Environmental Quality Fund #0225 during the fourth quarter of Fiscal Year 2016.

    c. Request in accordance with Senate Bill 1163, that $2,583,700.00 be transferred from the General Fund to the Department of Environmental Quality Fund #0225 during the fourth quarter of Fiscal Year 2016.

    d. Request in accordance with Senate Bill 1163, that $297,200.00 be transferred from the Water Pollution Control Fund #0200 to the Department of Environmental Quality Fund #0225 during the fourth quarter of Fiscal Year 2016.


    4. Department of Agriculture – Approved
    Request approval pursuant to Idaho Code §22-2019 for deficiency warrant spending authority for the following items:

    Japanese Beetle Eradication and Surveillance Project: $124,800
    Eradication Treatment: $185,400
    Survey, Detection and Eradication Programs for Pests and Diseases: $35,00

    Total authorization requested for March 1, 2016 through February 28, 2017: $345,200


    5. Department of Administration, Division of Purchasing – Approved
    Request for recognition of assignment of two contracts from Alpha Ten Technologies, Inc. to Fidelis Security Group, Inc.



    REGULAR AGENDA


    6. Office of the State Treasurer – Approved
    Request pursuant to Idaho Code §63-3201 to issue tax anticipation notes that will not exceed 75% of the anticipated income or revenue from taxes during FY2017.

    Discussion: Mr. Crane explained that he anticipates borrowing in the neighborhood of $500 million, which is standard.

    Gov. Otter asked what is the penalty if the state over borrows.

    Mr. Crane stated that the state can borrow no more than 90% of its deficit on November 15, per the IRS. We can borrow up to $3.4 billion, but would never do that. It is very restrictive.

    Gov. Otter asked what is the penalty.

    Mr. Crane answered that we would forfeit all interest.

    Gov. Otter asked what we will pay this year.

    Mr. Crane said that he is unsure what will happen this year. He will go to New York for Idaho’s presentation in May this year instead of June.

    Resolution: Mr. Wasden moved to approve item 6. Mr. Denney seconded the motion. The motion carried on a unanimous voice vote.


    7. Department of Administration – Approved
    a. Request approval for the payment of attorney’s fees, costs, and expenses in Syringa Networks, LLC v. Idaho Department of Administration, et al., in the amount of $930,593.17 plus judgement interest at the rate of 5.125% per annum from June 30, 2015 until paid.

    b. (Subject to a motion and approval to amend) - Approved
    Request for approval for the payment of costs on appeal in Syringa Networks, LLC v. Idaho Department of Administration, et al., in the amount of $1,248.50.

    Discussion: Brian Kane explained that the purpose of this item is to go to the legislature and get an appropriation to pay this bill through the legislative process prior to their departure.

    Resolution: Mr. Wasden moved to approve item 7 a. and b. Mr. Denney seconded the motion. The motion carried on a unanimous voice vote.



    INFORMATIONAL AGENDA

    8. Office of the Attorney General
      a. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Pennie Soltero.

      b. Notification that Steven R. Fuller of the firm of Fuller & Fuller, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Robin Harris.

      c. Notification that Daniel A. Miller of the firm of Ludwig, Shoufler, Miller & Johnson, LLP, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Michael Parent.

      d. Notification that Bren E. Mollerup of the firm of Benoit, Alexander, Harwood & High, LLP, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Joel Climer.
