STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
March 20, 2012 – 8:55 a.m.
Borah Post Office Building, 204 N. 8th Street, 2nd Floor Courtroom

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.

The following board members were present: Governor C.L. “Butch” Otter and Secretary of State, Ben Ysursa and Attorney General Lawrence Wasden. Controller Donna M. Jones, Secretary to the State Board of Examiners recorded the proceedings of the meeting and was present via telephone.


Ms. Jones introduced the consent agenda items.
Mr. Wasden moved to approve the consent agenda. Mr. Ysursa seconded the motion. The motion passed on unanimous voice vote.
CONSENT AGENDA

1. Minutes - Approved
Approval of official minutes for the meeting of the Board of Examiners on February 21, 2012.

    Request for recognition of assignment pursuant to Idaho Code §67-1027 from Delbert Kerr to David and Nancy Lewis Family Trust.

      4. Idaho State Police – Approved
      Request approval to add 2012 Coeur d’ Alene Ironman Triathlon (World Triathlon Corporation) to their previously approved list of grants, permitting ISP to pay its employees for all actual hours worked, including overtime, for providing traffic and safety enforcement for the Coeur d’ Alene Ironman Competition.

      5. State Tax Commission – Approved
      Request for approval pursuant to Idaho Code §63-3067(2) for tentative transfer authority from the general fund to the refund fund.


      INFORMATIONAL AGENDA

      6. Office of the Attorney General
      a. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Gary D. Burlingame.

      b. Notification that M. Jay Meyers of the firm of Meyers Law Office, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Bill Locascio.

      c. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Shannon Mason.

      d. Notification that Barry Blonien of the firm of Miner, Barnhill & Galland, P.C., in Madison, Wisconsin, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General to participate on behalf of the State of Idaho in litigation filed against some members of the pharmaceutical industry related to the industry’s use of “average wholesale price” drug price methodology.

      e. Notification that Daniel R. Swetnam, Esq., of the firm of IceMiller, LLP in Columbus, Ohio, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the Public Employee Retirement System of Idaho in the case of Weisfelner v. Fund 1.

      f. Notification that Dr. Oliver Berg, Strasbourg, France, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the Public Employee Retirement system of Idaho in litigation it is bringing against Vivendi SA in France.
