MINUTES – Regular Meeting

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.
The following board members were present: Governor C.L. “Butch” Otter, Secretary of State, Ben Ysursa and Attorney General Lawrence Wasden. Controller Donna M. Jones, Secretary to the State Board of Examiners recorded the proceedings of the meeting.
Ms. Jones introduced the consent agenda items.
Mr. Wasden moved to approve the consent agenda. Mr. Ysursa seconded the motion. The motion passed on unanimous voice vote.CONSENT AGENDA
1. Minutes - Approved
Approval of official minutes for the meeting of the Board of Examiners on April 17, 2012.
2. Department of Administration – Approved
a. Request for recognition of assignment according to Idaho Code 67-1027 from Sawtooth Investment LLC to Dietrich Group LLC. (Idaho State Lottery Commission is lessee.)
b. Request for recognition of assignment according to Idaho Code 67-1027 from Sawtooth Investment LLC to Dietrich Group LLC. (Idaho Board of Pharmacy is lessee.)
c. Request for recognition of assignment according to Idaho Code 67-1027 from KMP Development Corp. to KMP Companies LLC.
3. Bureau of Homeland Security – Approved

4. Military Division – Approved
Ratification of military contract for NGBID-12-C-0007 for State of Idaho Military Division project: MATES Main Electrical Switchgear.
5. Department of Health and Welfare – Approved
Request approval that $124,908,550 be transferred from the General Fund to the Cooperative Welfare Fund #0220 during the 4th Quarter of Fiscal Year 2012. Additionally, $63,275 is requested to be transferred from the Drug Court, Mental Health & Family Court Services Fund #0340 to the Cooperative Welfare Fund #0220 during the 4th Quarter of Fiscal Year 2012.
6. Department of Agriculture – Approved
Request approval pursuant to Idaho Code 22-2019 for deficiency warrant spending authority for survey, detection and eradication programs for pests and diseases in the amount of $75,000.
7. Department of Labor – Approved
Request approval pursuant to Idaho Code 72-1348 to use Penalty and Interest monies in the amount of $20,000 to help the Department of Administration fund a review of the Idaho State Network.
8. Office of the Secretary of State – Approved
Request approval pursuant to Idaho Code 67-910(3) to establish a fee of $30.00 to be charged by the Secretary of State for an application for reinstatement following administrative dissolution of a limited liability company.
9. Ada County Sheriff’s Office – Approved
Request for approval pursuant to Idaho Code §31-2219, and Idaho Code §31-3203, for prisoners sentenced to ISCI and transported to the Ada County Jail upon a Judgment of conviction or a Return on a Board Warrant for January 2012 through March 2012.

10. Office of the Attorney General
Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Kathleen Hanson.
Notification that Randall A. Peterman of the firm of Moffatt, Thomas, Barrett, Rock & Fields, Chtd., has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Public Employee Retirement System of Idaho, in the case of Diane Keith.
Notification that Peter J. Johnson of Johnson Law Group in Spokane, Washington, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Idaho State Police, in the case of Pruczinski v. Ashby.
Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General to represent the State of Idaho, Industrial Special Indemnity Fund, in the matter of Michael Garcia.
Notification that Randall R. Adams of the firm of Adams & Gaffaney, LLP, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing The Honorable John T. Mitchell in the case of Watson v. Mitchell.
Notification that Deputy Attorney General Jessica Lorello to accept additional outside employment at Concordia University School of Law in an educational program conducted under the supervision of the State Board of Education. She will teach a course in Legal Research & Writing two evenings per week beginning in the fall semester of 2012.

Mr. Ysursa moved to adjourn the meeting. Mr. Wasden seconded the motion.
