MINUTES – REGULAR MEETING

The regular meeting of the State Board of Examiners was called to order at 204 N. 8th Street, Boise, Idaho, at 2:33 p.m. pursuant to Idaho Code §67-2002 and by order of the chair.
The following board members were present: Governor Jim Risch, chairman of the board; and Secretary of State Ben Ysursa. Attorney General Lawrence Wasden was absent.
State Controller Keith Johnson, secretary to the board, recorded the proceedings of the meeting.
Mr. Johnson introduced the items on the consent agenda. Mr. Ysursa moved to approve the consent agenda as recommended in its entirety; Mr. Risch seconded the motion. The motion carried by unanimous voice vote.
Request for authorization to issue deficiency warrants for reimbursement of response costs pursuant to Idaho Code §39-7110.

5. Office of the State Treasurer – Approved
Request for approval of the State Treasurer’s annual investment fee to be charged to state agencies for FY 2007 in accordance with Idaho Code 67-1210 and Idaho Code 67-3524.
6. Idaho Commerce and Labor – Approved up to $1,275,000 for construction of the department’s Idaho Falls local office building. Deferred the request to use up to $100,000 to support Idaho TechConnect, Inc.
Request for approval to use Penalty and Interest monies under Idaho Code 72-1348 for the following:
Up to $100,000 to support Idaho TechConnect, Inc.
Up to $1,275,000 for construction of the department’s Idaho Falls local office building.

13. Department of Administration – Approved
Request for recognition of assignment pursuant to Idaho Code §67-1027 from Roylance & Associates P.A. to The Land Group, Inc.
Mr. Johnson introduced the items on the regular agenda.
2. Boise State University - Approved
Request for permission to reimburse Brent Pease, Assistant Boise State Football Coach, up to $13,200 in relocation costs.
Annual Salary: $85,000
Discussion: Mr. Gene Bleymaier, Boise State University Athletic Director said BSU requests the permission to use local funds from the athletic department above the 10% that is allowed to help relocate new coach, Mr. Pease. Mr. Bleymaier said there has been major shifting in coaches this year. Mr. Bleymaier said eleven coaching positions have been hired recently, but only seven of those coaches have needed funds to relocate. Mr. Bleymaier said that combined, those seven coaches’ allowable moving expenses would have totaled almost $70,000. Mr. Bleymaier said if the $4,700 is approved for coach Pease to relocate, the total BSU would have spent on relocation costs will have totaled $53,000. Mr. Bleymaier said Mr. Pease got five moving bids and accepted the lowest bid to move his family of four from Waco, Texas.
Mr. Ysursa said he appreciates Mr. Bleymaier saving money by retaining some of BSU’s staff and by using money from local funds.
Resolutions: Mr. Ysursa moved to approve item 2. Mr. Risch seconded the motion. The motion carried by unanimous voice vote.
3. Idaho School for the Deaf and the Blind – Item Removed
Request for permission to exceed the current $1,000 bonus limitation for Carrie Arkoosh, ISDB RN Manager.
4. Idaho Transportation Department - Approved
Request for approval for additional relocation costs of $2,000 for the hiring of a Senior Transportation Planner position in our Coeur D’ Alene District Office.
Discussion: Gordon Wilmoth, a financial manager for the Idaho Transportation Department requested approval for additional funds to move a new employee from Greenbay, Wisconsin. Mr. Wilmoth said there is a $5,000 moving limit, but the new hire needs another $2,000 above his salary of $54,000. Mr. Wilmoth said the new employee’s family will bring two Ryder vans with them, fly back at their own expense, and then drive their own two vehicles to Idaho, as opposed to hiring professional movers.
Mr. Risch asked why this position would be so difficult to fill.
Mr. Wilmoth commented that finding a Senior Transportation Planner was a challenge because there seems to be a nationwide demand for planning-type individuals. Mr. Wilmoth said other local entities in Idaho and elsewhere are willing to pay more for this position than the Transportation Department is able. Mr. WIlmoth said the new hire’s duties will include dealing with local counties and highway districts in putting together a statewide improvement plan and working toward getting projects ready to advertise.
Resolutions: Mr. Ysursa moved to approve item 4. Mr. Risch seconded the motion. The motion carried by unanimous voice vote.

Notification of closure of rotary fund 0830 for the Idaho Commission of the Blind and Visually Impaired effective May 8, 2006.

10. Attorney General
Notification that Bradlee R. Frazer of the firm of Technology Law Group, LLC, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of advising the Idaho State Lottery on intellectual property matters related to the Lottery’s creation and design of instant ticket scratch games.
Notification that Richard Wyde of the firm of Davis, Wright, Tremaine, LLP, in Seattle, Washington, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of reviewing and making recommendations as to the Requests for Proposals for the reprocurement of the Medicaid Management Information System and related work requested by the Idaho Department of Health and Welfare.
Notification that David E. Spurling, Colonel, IDARNG, Staff Judge Advocate, Idaho Army National Guards has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho Military Division in contract matters.
Notification that David Zaslowsky of the firm of Baker & McKenzie, LLP, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho defendants in case of G&T Terminal Packaging Co., Inc. v. Idaho Potato Commission, etal., Supreme Court of the State of New York, County of Bronx, Index No. 15034-06.
