STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
June 17, 2014 – 8:55 a.m.
Capitol Lincoln Auditorium (WW02), Lower Level, West Wing

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.

The following board members were present: Governor C.L. “Butch” Otter, Secretary of State Ben Ysursa, and Attorney General Lawrence Wasden. State Controller Brandon Woolf recorded the proceedings of the meeting.

Mr. Woolf introduced the consent agenda items.

Mr. Wasden moved to approve the consent agenda. Mr. Ysursa seconded the motion. The motion passed on a unanimous voice vote.

CONSENT AGENDA

    3. Office of the State Treasurer – Approved
    Request approval pursuant to Idaho Code §67-1210 and §67-3524 for the annual investment fee to be charged to state agencies for fiscal year 2015. The investment administrative fee would increase from .018% to .037%.


    4. Department of Correction – Approved
    Request approval to use the ONL pay code for critical security staffing needs in the South Boise Prison Complex from June 22, 2014 to November 9, 2014.


    REGULAR AGENDA

    5. Charney and Associates, PLLC - Not Approved
    Request reimbursement for Medicaid provider underpayment to Inclusion, Inc., Inclusion North, Inc., and Inclusion South, Inc.

    Discussion: Mr. Carl Withroe, Deputy Attorney General, explained that there are two ongoing court cases with this claim. The first is a federal claim; the second is in state court. The case has gone to judgment with a ruling against the plaintiff (Inclusion, Inc.). Mr. Withroe opined that he believed the plaintiffs’ chance of appeal is very low.

    Mr. Wasden asked if the claim has been submitted to the Director of the Department of Health and Welfare.

    Mr. Withroe answered that it has not been submitted to the Director, but to the courts.

    Resolution: Mr. Wasden moved to reject item 5. Mr. Ysursa seconded the motion. The motion carried on a unanimous voice vote.
