STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
June 19, 2012 – 8:55 a.m.
State Capitol Lower Level, West Wing

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.

The following board members were present: Governor C.L. “Butch” Otter, Secretary of State, Ben Ysursa and Attorney General Lawrence Wasden by telephone. Brian Benjamin, Deputy Chief of Staff for the Office of the State Controller, recorded the proceedings of the meeting.

Governor Otter gave a brief update on Controller Jones’ medical progress after her vehicle accident, and that she is receiving rehabilitation therapy daily. She is grateful for all of the cards, prayers, and support.

Mr. Benjamin introduced the consent agenda items.
Mr. Ysursa moved to approve the consent agenda. Mr. Wasden seconded the motion. The motion passed on unanimous voice vote.
CONSENT AGENDA

1. Minutes - Approved
Approval of official minutes for the meeting of the Board of Examiners on May 15, 2012.

    2. Department of Administration – Approved
    Request for recognition of assignment according to Idaho Code 67-1027 from Bank of the Cascades to Raft River Investments, LLC. (Idaho Department of Labor is Lessee.)

      4. Military Division – Approved
      Request for approval pursuant to Idaho Code §72-928 of payment of worker’s compensation claims for members of the Idaho National Guard, resulting while the soldier was on duty in the amount of $2,592.06.


      5. Association of Public Health District Directors – Approved
      Request to authorize distribution of FY 2013 state general funds and millennium funds.


      6. Office of the State Treasurer – Approved
      Request approval pursuant to Idaho Code 67-1210 and 67-3524 for the annual investment fee to be charged to state agencies for FY 2013.


      7. Idaho State Police – Approved
      a. Request approval according to Idaho Code 67-5302(20) for the list of grants, projects, and agreements for overtime shifts worked by Idaho State Police employees.
      b. Request an extension for FY2013 for the previously approved request to provide payment of overtime for Forensic Scientist 2, Forensic Scientist 3, Forensic Scientist 4 and Lab Manager positions.


      8. Parks and Recreation – Recommend approval - Approved
      Request an exception to the State’s Real Estate Relocation Policy and Procedures to pay for additional months related to terminating a rental lease, if needed, for an employee who is being involuntarily transferred.

      9. Division of Veterans Services - Item withdrawn by agency
      Request that the compensatory time be paid pursuant to Idaho Code 67-5328(c) for an employee who is now employed at the Idaho State Veterans Home in Boise for the first quarter of FY2013.


      INFORMATIONAL AGENDA

      10. Office of the Attorney General
      a. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Daniel W. Byers.

      b. Notification that Peter J. Johnson of Johnson Law Group, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho in the case of Joerger v. State of Idaho Department of Transportation.

      11. State Insurance Fund
      a. Estimate of the State Insurance Fund expenses to be paid by sight drafts for the month of
      April, 2012.
