STATE BOARD OF EXAMINERS
MINUTES – REGULAR MEETING
700 W. State Street, Boise, Idaho
1st Floor, East Conference Room
July 13, 2004


The regular meeting of the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 8:55 a.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following board members were present, constituting all the members: Secretary of State Ben Ysursa, acting chairman of the board; and Attorney General Lawrence Wasden.

State Controller Keith Johnson, secretary to the board, recorded the proceedings of the meeting.


· CONSENT AGENDA
Mr. Johnson introduced the items on the consent agenda. Mr. Wasden moved to approve the consent agenda as recommended in its entirety; Mr. Ysursa seconded the motion. The motion carried by unanimous voice vote.

1. Minutes – Approved

    Approval of official minutes for the meeting of the to Board of Examiners on June 14th, 2004.

2. Department of Administration – Approved
    b. Request for Recognition of Assignment from June Ringheimer to Noah and Carol Rae.

3. University of Idaho – Approved $13,500
    Request to reimburse moving expenses of up to $15,000 for Dr. Demetrios Kzazkos, Chair for the Department of Electrical Engineering and Computer Science to move from the Toledo, Ohio to Moscow, Idaho. Payment of Dr. Parrish’s moving expenses will be from General Education state funds. The annual salary for this position is $135,333.00.

4. Idaho State University – Approved 10% of salary
    Request to reimburse the following moving expenses:

a. Moving expenses of $14,000 for the Chief Research Officer/Senior Associate to the Academic Vice President, PCN 3658. Annual Salary: $140,004.80.
b. Moving expenses of $8,000 for the Associate Professor of Pharmaceutical Sciences, College of Pharmacy, PCN 3617. Annual Salary: $66,000.00.
c. Moving expenses of $8,000 for the Associate Professor of Pharmaceutical Sciences, College of Pharmacy, PCN 3618. Annual Salary: $66,000.00.
d. Moving expenses of $8,000 for the Associate Professor of Pharmaceutical Sciences, College of Pharmacy, PCN 3136. Annual Salary: $66,000.00.
5. Boise State University – Approved
    Request to reimburse moving expenses of up to $3,800 for Alicia Hedges, Senior Accountant for Boise State Radio, PCN# 3157 for moving expenses incurred on January 27th, 2004. Payment of Ms. Hedges’ moving expenses will be from General Education state funds. The annual salary for this position is $38,000.00.

6. Office of Secretary of State – Approved
    Request for consideration of distribution list for the Idaho Code pursuant to Idaho Code §73-212.

7. Department of Health & Welfare – Approved
    Request for approval to revert $423,950.00 to the General Fund from the Cooperative Welfare Fund #0220 that was not utilized in the State Fiscal Year 2004 appropriation for Shelter Workshops in accordance with Senate Bill 1425, Section 6.

8. Bureau of Hazardous Materials, Division of Military, Executive Office Of Governor – Approved
    Request for authorization to issue deficiency warrants for reimbursement of response costs incurred during June pursuant to Idaho Code §39-7110.

9. Department of Commerce & Labor – Approved
    Request for approval to use $18,000 of Penalty and Interest monies for 2004-2005 membership dues for the National Associate of State Workforce Agencies.


· REGULAR AGENDA
10. Moving Policy Recommendation – Approved
    Subcommittee recommends the following changes:

    Reimbursements shall:

          Be limited to 10% of base salary including all fund sources

          Not to exceed $15,000

          Be for household, irrespective of marital status

          In the case of multiple hires, receive the salary reimbursement based on the highest member salary

          Be accounted for annually on 12-31 by the agency

    Other changes:

· Strike pound limit
· Retain extra vehicle provision
· Strike commercial mover provision of personal vehicles
· Strike provision for packing
Discussion: Mr. Johnson introduced item 10 to the board. Mr. Wasden stated that it was his understanding that the universities are in favor of this policy. Mr. Ysursa called for a motion.

Resolution: Mr. Wasden moved to approve item 9. Mr. Ysursa seconded the motion. The motion carried with a unanimous voice vote.



· INFORMATIONAL AGENDA
11. Attorney General
    Notification that Anne Goodwin Crump of the Arlington, Virginia firm of Fletcher Heald & Hildreth has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in case of Idaho Public Television/KUID-TV FCC Audit 62382.

    Notification that Anne Goodwin Crump of the Arlington, Virginia firm of Fletcher Heald & Hildreth has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in case of Idaho Public Television/KUID-TV FCC Audit 62430.

    Notification that Steven J. Wright of the firm of Wright, Wright & Johnson has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho, Department of Health & Welfare, Bureau of Child Support in child support collections.

    Notification that Peter J. Johnson of the Johnson Law Group in Spokane, Washington has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in case of Carter v. Idaho State Transp. Dep’t, CV-2004-00220.
