STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
September 18, 2012 – 8:55 a.m.

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.

The following board members were present: Governor C.L. “Butch” Otter, Secretary of State Ben Ysursa and Attorney General Lawrence Wasden. Brandon Woolf Acting State Controller, recorded the proceedings of the meeting.

Mr. Woolf notified the Board and audience that Controller Donna Jones has been released from the hospital and is continuing rehabilitation each week.

Mr. Wasden commented that he spoke with Donna recently and she has not lost her sense of humor. He also expressed condolences to Secretary Ysursa’s family on the passing of his mother-in-law.

Mr. Woolf introduced the consent agenda items.
Mr. Wasden moved to approve the consent agenda. Mr. Ysursa seconded the motion. The motion passed on unanimous voice vote.
CONSENT AGENDA

1. Minutes - Approved
    Approval of official minutes for the meeting of the Board of Examiners on August 21, 2012.

2. Department of Administration – Approved
    Request for recognition of assignment pursuant to Idaho Code §67-1027 from Janet & George Starcevich to North State Industries, Inc. (Idaho Industrial Commission is Lessee.)

    Ratification of military contracts:
    NGBID-12-C-0013 for Range 1 Improvements (Phase 1)

5. Ada County Clerk – Approved
    Request for approval pursuant to Idaho Code §18-2507, for the prosecution of State Penitentiary inmates in the amount of $414.05.

6. Department of Agriculture – Approved
    Request approval for deficiency warrant spending authority pursuant to Idaho Code §22-2019 for the Potato Cyst Nematode Survey, Detection and Eradication Program in the amount of $225, 000.00 for September 1, 2012 through September 1, 2013.

    Discussion: Gov. Otter asked Mr. Lloyd Knight to explain the department’s item.

    Mr. Knight said the state department will do one final survey of 5,300 acres, making sure they did not miss anything. The surveys will take place in Bonneville and Bingham counties.

    Gov. Otter asked if this will get Idaho certification.

    Mr. Knight said the acres will be certified PCN free. However they are still finding fields that are infested.

    Gov. Otter asked if the fields are under fumigation.

    Mr. Knight said they are not being fumigated; they are just under surveillance at this time.


INFORMATIONAL AGENDA

7. Office of the Attorney General
    a. Notification that Peter J. Johnson of Johnson Law Group has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho and the State Department of Transportation in the case of Mark, et al. v. Idaho State Department of Transportation, et al.

    b. Notification that Peter J. Smith IV of the firm of Lukins & Annis, PS, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of providing assistance to the Idaho Department of Lands involving real property located in Valley County and Bonner County, Idaho.
