STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
November 16, 2010 – 8:30 a.m.
Borah Post Office Building, 204 N. 8th Street, 2nd Floor Courtroom
The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.
The following board members were present: Governor C.L. “Butch” Otter and Secretary of State Ben Ysursa. Attorney General Lawrence Wasden was absent. Controller Donna M. Jones, Secretary to the State Board of Examiners recorded the proceedings of the meeting.
Ms. Jones introduced the consent agenda items.
Resolution: Mr. Ysursa moved to approve the consent agenda. Governor Otter seconded the motion. The motion carried on a unanimous voice vote.
1. Minutes - Approved
Approval of official minutes for the meeting of the Board of Examiners on October 19, 2010.
2. Bureau of Homeland Security - Approved
a. Haz Mat deficiency warrant list
b. Update on incident 2009-237, a mercury spill at a private house in which the state is not seeking recovery for.

|Suspected drug lab found in the trunk of a vehicle at an impounded car lot. Suspect is in custody and the incident amount will be added to a restitution request with Twin Falls County Prosecutor. (Twin Falls County)||11/2/2010|
3. Military Division - Approved
Request for approval pursuant to Idaho Code §72-928 of payment of worker’s compensation claims for members of the Idaho National Guard, resulting while the soldier was on duty in the amount of $2,514.60.
4. Ada County - Approved
Request for approval pursuant to Idaho Code 18-2507, for the payment of costs incurred by Ada County for the prosecution of one State Penitentiary inmate in the amount of $1,201.50.
5. Minutes - Tabled until the December meeting
Review of the September 2010 sub-committee meeting notes.
6. Department of Fish and Game - Approved
Request an exemption to the State Real Estate Relocation Policy and Procedures on behalf of Mr. David Silcock.
Discussion: Mr. Ysursa noted that it looks like Mr. Silcock is making a good attempt at selling his home.
Gov. Otter asked if there are any on-going costs.
Mr. Jim Lukins answered that there are no direct costs to the state, but the ultimate reimbursement for fees would be $12,000-14,000.
Resolution: Mr. Ysursa moved to approve item 6. Gov. Otter seconded the motion. The motion carried on a unanimous voice vote.
7. Department of Fish and Game
Notification that Joseph Dupont has sold his home and has been reimbursed his allowable relocation expenses.
8. Office of the Attorney General
Notification that Paul J. Augustine of the firm of Augustine Law Office, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho in the matters of David Tarbet and Wayne Severson.
Notification that Paul J. Augustine of the firm of Augustine Law Office, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho in the matter of State of Idaho in the matters of Estelle Lieske and Donald Laughlin.
Notification that Mary V. York of the firm of Holland & Hart, LLP, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho Transportation Department in legal matters concerning eminent domain issues for the US-95 construction corridor between Coeur d’ Alene and Sandpoint, Idaho.
Notification that Joshua S. Evett of the firm of Elam & Burke, PA, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing Idaho Public Television in a copyright infringement issue involving IPTV footage used in a television advertisement that concerns the upcoming election for Superintendent of Public Instruction.
Notification that Larry C. Hunter of the firm of Moffatt, Thomas, Barrett, Rock & Fields, Chtd., has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho in the matter of Idaho State Board of Accountancy v. Thurston.
Notification that Peter J. Johnson with Johnson Law Group in Spokane, Washington, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho in the matter of Wylie v. Idaho Department of Correction.
9. State Insurance Fund
a. Estimate of the State Insurance Fund expenses to be paid by sight drafts for the month of September, 2010.
b. Estimate of the Petroleum Clean Water Trust Fund expenses to be paid by sight draft for the month of September, 2010.
