STATE BOARD OF EXAMINERS
MINUTES – Regular Meeting
December 20, 2016 – 9:01 a.m.

The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair.

The following board members were present: Governor C.L. “Butch” Otter, Attorney General Lawrence Wasden, and Secretary of State Lawerence Denney. State Controller Brandon Woolf recorded the proceedings of the meeting.

State Controller Woolf introduced the consent agenda items.

Attorney General Wasden moved to approve the consent agenda. Secretary of State Denney seconded the motion. The motion passed on a unanimous voice vote.

3. Office of the Attorney General – Approved
Payment of attorney’s Fees, Costs and Expenses in Visual Arts Collective, LLC v. Powell.
    4. Department of Environmental Quality – Approved
    a. Request in accordance with Senate Bill 1415, that $504,799.00 be transferred from the Public Water System Supervision Fund #0191 to the Department of Environmental Quality Fund #0225 during the third quarter of Fiscal Year 2017.

    b. Request in accordance with Senate Bill 1415, that $4,243,104.00 be transferred from the General Fund to the Department of Environmental Quality Fund #0225 during the third quarter of Fiscal Year 2017.

    c. Request in accordance with Senate Bill 1415, that $309,373.00 be transferred from the Water Pollution Control Fund #0200 to the Department of Environmental Quality Fund #0225.


    d. Request in accordance with Senate Bill 1415, that $750,000.00 be transferred from the Water Pollution Control Fund #0200 to the Environmental Remediation Fund #0201 on January 20, 2016, to complete the full $1,500,000.00 for Fiscal Year 2017.


    5. Department of Health and Welfare – Approved
    Request to have $164,507,800 transferred from the General Fund to the Cooperative Welfare Fund #0220 during the 3rd Quarter of Fiscal Year 2017 in accordance with appropriations.

    6. Department of Admin Division of Purchasing – Approved
      Request to assign contract Number CPO02669 a contract for Museum Exhibit Renovations on behalf of the Idaho State Historical Society, from Lexington Acquisitions, Inc. to The Nassal Company.

      Discussion:
      Governor Otter asked if this went out for review or bid.

      Ms. Valerie Bollinger from the Division of Purchasing addressed this question and indicated that the Idaho State Historical Society had reviewed this matter. Specifically, The Nassal Company is acquiring the assets of Lexington Acquisitions, Inc., the company that originally won the RFP. Analysis completed by DOP determined that The Nassal Company was better than or equal to Lexington Acquisitions, Inc. Nassal did not respond to the original RFP but agreed to accept any liability, and the Attorney General’s office has approved this assignment.

    7. Office of the State Controller – Approved
      Request for approval to change the state mileage reimbursement rate from 54 cents per mile to 53.5 cents per mile effective January 1, 2017. This will make the state mileage rate correspond with the federal rate set by the IRS beginning January 1, 2017.

    8. Office of the Attorney General
      a. Notification that Bren E. Mollerup of the firm of Benoit, Alexander, Harwood, High & Mollerup, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Joel Climer.
        b. Notification that Daniel A. Miller of the firm of Ludwig, Shoufler, Miller & Johnson, LLP, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Rodney W. Mason.
          c. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Maria Flores.
            d. Notification that Edwin L. Litteneker, Attorney at Law, has been appointed as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Transportation Department, in any appeal from a hearing officer’s decision filed pursuant to Idaho Code § 18-8002A, Automatic License Suspension Program. This appointment is effective through December 31, 2017.
              e. Notification that Stephen J. Muhonen of the firm Racine, Olson, Nye, Budge & Bailey, Chtd., has been appointed as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Transportation Department, in any appeal from a hearing officer’s decision filed pursuant to Idaho Code § 18-8002A, Automatic License Suspension Program. This appointment is effective through December 31, 2017.
                f. Notification that Susan K. Servick, Attorney at Law, has been appointed as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Transportation Department, in any appeal from a hearing officer’s decision filed pursuant to Idaho Code § 18-8002A, Automatic License Suspension Program. This appointment is effective through December 31, 2017.
                  g. Notification that Timothy J. Stover of the firm Worst, Fitzgerald & Stover, PLLC, has been appointed as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Transportation Department, in any appeal from a hearing officer’s decision filed pursuant to Idaho Code § 18-8002A, Automatic License Suspension Program. This appointment is effective through December 31, 2017.
                    h. Notification that Dennis P. Wilkinson of the firm Thompson, Smith, Woolf, Anderson, Wilkinson & Birch, PLLC, has been appointed as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Transportation Department, in any appeal from a hearing officer’s decision filed pursuant to Idaho Code § 18-8002A, Automatic License Suspension Program. This appointment is effective through December 31, 2017.
