STATE BOARD OF EXAMINERS
MINUTES – Sub-committee Meeting
March 12, 2013 – 1:30 p.m.
Joe R. Williams Building, 5th Floor Conference Room A

The regular meeting of the Subcommittee to the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 1:30 p.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following members were present: Brian Kane, Office of the Attorney General; Jani Revier, Division of Financial Management; Tim Hurst, Secretary of State’s Office; and Brian Benjamin, Office of the State Controller, as assisting secretary to the subcommittee.

Also present by invitation were: Lloyd Knight, Department of Agriculture; Mike Cooper, Department of Agriculture; Kelly Nielsen, Department of Agriculture; Mark Poppler, Tax Commission; David Fulkerson, Division of Financial Management; and Deborah Wonch, Office of the State Controller.
CONSENT AGENDA

1. Minutes
    Approval of official minutes for the meeting of the Sub-committee to the Board of Examiners on February 12, 2013.

    Resolution: Mr. Kane moved to approve item 1. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

REGULAR AGENDA

2. Department of Agriculture
    Request approval pursuant to Idaho Code §22-2019 for deficiency warrant spending authority for the following items:

    a. Japanese Beetle Eradication and Surveillance Project: $144,700
    b. Survey, Detection and Eradication Programs for Pests and Diseases: $35,000

    Total authorization requested for March 1, 2013 through February 28, 2014: $179,700

    Discussion: Mr. Cooper explained that last year the funds were used when they found a bunch of Japanese beetles that had been in a shipment from a nursery back east. Kathryn Albertson Park and the Boise Rose Garden among other places, reportedly caught beetles. Traps were placed and they caught around 2 dozen. There might be an infestation going on in a four block area of downtown. The Department has run the beetles through an isotope lab to find out what part of the country the beetles came from. It will be ongoing for a couple of years. There are quarantines in surrounding states against this beetle.

    Ms. Revier asked how the Department kills the beetles.

    Mr. Cooper answered they kill the beetles with granular insecticides, similar to treatment for billbugs. The timing is to get the insecticide down at the end of June when the beetles are hatching larvae.

    Mr. Hurst asked how much money the Department has.

    Mr. Cooper responded that they have never had a budget for this.

    Resolution: Mr. Kane moved to approve item 2 and place it on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

3. Idaho Tax Commission
    Request for approval pursuant to Idaho Code §63-3067(2) for tentative transfer authority from the general fund to the refund fund. To accomplish this, the Commission asks that the transfer authority be for up to $20,000,000, in increments of $10,000,000 as needed.

    Resolution: Mr. Kane moved to approve item 3 and place it on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.


INFORMATIONAL AGENDA

4. Office of the Attorney General
    a. Notification that Peter J. Crossett of the firm of Hiscock & Barclay, LLP, in Syracuse, New York, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the Idaho State Tax Commission in the matter of operating property tax appeals to the Idaho District Court from the Idaho State Tax Commission for PacifiCorp for tax years 2009, 2010, 2011, 2012, and 2013 and for Idaho Power Company tax years 2010, 2011, 2012, and 2013.
    b. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of James P. Daniel.
