STATE BOARD OF EXAMINERS
MINUTES – SUBCOMMITTEE MEETING
700 W. State Street, Boise, Idaho

The regular meeting of the Subcommittee to the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 9:05 a.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following members were present: Brad Foltman, Governor’s Office; Chuck Goodenough, Office of the Secretary of State; Dave High, Office of the Attorney General; and Patrick Hodges, Office of the State Controller, as assisting secretary to the subcommittee.

Also present by invitation were: Conrad J. Aiken, Racine Olson Nye Budge & Bailey Chartered; Alex L. Westfall, Washington Trust Bank, Richard Humiston, Department of Health and Welfare, Susan Lowman-Thomas, Division of Veterans Services, Ann Heilman, Division of Human Resources; Brandon Woolf, Office of the State Controlle, Bryn Field, Office of the State Controlle, Dan Goicoechea, Office of the State Controller

CONSENT AGENDA

1. Minutes

    Approval of official minutes for the meeting of the Subcommittee to the Board of Examiners on March 9, 2006.

Resolution: Mr. High moved to approve item 1. Mr. Foltman seconded the motion. The motion carried on a unanimous voice vote.

2. Department of Administration
a. Request for recognition of assignment pursuant to Idaho Code §67-1027 from ABC, LLC to Maynard Alves.
b. Request for recognition of assignment pursuant to Idaho Code §67-1027 from 3rd Chancellor to 3rd and 3rd Investors.
Resolution: Mr. High moved to approve item 2. Mr. Foltman seconded the motion. The motion carried on a unanimous voice vote.

3. Health and Welfare – Conrad J. Aiken, Racine Olson Nye Budge & Bailey Chartered

    Request for recognition of assignment as executed by Assignor Business Psychology Associates, Inc. and Assignee Washington Trust Bank, both of Boise, Idaho, for security rights to payment from Idaho Department of Health and Welfare Contract Number KC 203100 pursuant to Idaho Code §67-1027.

Discussion: Mr. Goodenough asked why this Recognition of Assignment did not go through the Department of Administration.

Conrad J. Aiken said they had a similar assignment go through the board in 2003.

Resolution: Mr. Goodenough moved to approve item 3. Mr. High seconded the motion. The motion carried on a unanimous voice vote.

4. Division of Veterans Services – Susan Lowman-Thomas, Senior HR Specialist

    Request to lift the maximum limit for vacation accrual for six (6) months for the following employee:

      Jeremy J. Durham
      Senior Cook - PCN 1861
      Leave Schedule: BA Regular
      Vacation Balance (3/27/06): 223.6 hours
      FLSA Indicator: Covered
Audience with the Board: Susan Lowman-Thomas said Mr. Durham has been unable to take vacation because of the demands placed upon him due to several dietary unit vacancies caused by non-workforce related injuries. Ms. Lowman-Thomas said Mr. Durham’s supervisor is confident the situation will turn around in a few months.

Resolution: Mr. Goodenough moved to approve item 4. Mr. Foltman seconded the motion. The motion carried on a unanimous voice vote.

5. Military Division

    Request for approval of payment of worker’s compensation claims for members of the Idaho National Guard, resulting while the soldier was on duty, in the amount of $5,523.90.

Resolution: Mr. High moved to approve item 5. Mr. Foltman seconded the motion. The motion carried on a unanimous voice vote.


10. Attorney General

    Request to pay attorneys’ fees and costs against the State in the case of Planned Parenthood of Idaho v. Wasden and Bower in the amount of $380,525.74.

Discussion: Mr. High said the federal court does not wait for payment of this claim from the legislature’s appropriations from next year’s legislative session, so there needed to be an immediate way to handle the payment. Mr. High said a possible method of payment could be a warrant from the general fund.

Mr. Foltman recommended paying the claim by appropriation from the legislature or by moneys from the Constitutional Defense Fund. Mr. Foltman recommended the subcommittee identify the appropriate method of payment before the April 11 board meeting.

Resolution: Mr. Foltman moved to approve item 10 to the Regular Agenda pending identification of the method of payment at the Tuesday, April 11, 2006, Board of Examiner’s Meeting. Mr. Goodenough seconded the motion. The motion carried on a unanimous voice vote.

6. State Controller’s Office
a. Notification of closure of rotary fund 0807 for Idaho Public Television effective March 21, 2006.
b. Notification of closure of rotary fund 0847 for PERSI effective March 30, 2006.

7. Attorney General

    Notification that Hollis Mercer, Attorney at Law, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in case of Mercile v. Indust. Special Indem. Fund, IC# 05-503854, ISIF# 2006-1769; Romney v. Indust. Special Indem. Fund, IC# 02-019255, ISIF# 2006-1768.

    Notification that Lawrence E. Kirkendall, Attorney at Law, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in case of Garcia v. Indust. Special Indem. Fund, IC# 02-523960, ISIF# 2005-1761.

    Notification that Hollis Mercer, Attorney at Law, has been appointed pursuant to Idaho Code §67-1409 as a special deputy attorney general for the purpose of representing the State of Idaho in case of Shatto v. Indust. Special Indem. Fund. IC# 01-503935 & 03-514886, ISIF# 2006-1771; Reese v. Indust. Special Indem. Fund, IC# 00-039979, ISIF# 2006-1774.

Discussion: One additional item was added to the agenda for discussion concerning some state agencies who were considering reimbursing state employees who purchase alternate transportation passes. The Subcommittee said employees are not discouraged from purchasing their own alternate transportation passes, but under the current State Board of Examiner’s Travel Policy, the state cannot reimburse employees for "travel between home and office or for other non-official purposes." The Subcommittee said a memo should be written informing state agency directors, fiscal officers and HR officers to stop any reimbursement of alternative transportation passes to their agency’s employees.
