STATE BOARD OF EXAMINERS
MINUTES – Sub-committee Meeting
May 12, 2015 – 1:30 p.m.
Joe R. Williams Building, 5th Floor Conference Room A

The regular meeting of the Subcommittee to the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 1:30 p.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following members were present: Steven Olsen, Office of the Attorney General; Jani Revier, Division of Financial Management; Tim Hurst, Office of the Secretary of State; and Brian Benjamin, Office of the State Controller, as assisting secretary to the subcommittee.

Also present by invitation were: Josh Tewalt, Department of Correction; Lisa Johnson, Department of Correction; David Fulkerson, Division of Human Resources; and Debbie Wonch, Office of the State Controller.

Mr. Hurst moved to add the Department of Correction’s additional request to the agenda as item 3.b. Mr. Olsen seconded the motion. The motion carried on a unanimous voice vote.

CONSENT AGENDA

1. Minutes
Approval of official minutes for the meeting of the Sub-committee to the Board of Examiners on April 14, 2015.

Resolution: Mr. Hurst moved to approve item 1. Mrs. Revier seconded the motion. The motion carried on a unanimous voice vote.


    REGULAR AGENDA

    2. Military Division
    Request continuance of approval for cash compensation of overtime for state year 2016, to all state professionals and administrative personnel deployed to assist on state or federally declared disasters pursuant to Idaho Code §67-5328(3C).

    Resolution: Mr. Olsen moved to approve item 2 and place it on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.


    3. Department of Correction
    a. Request approval to provide per diem and travel expenses for Idaho’s Interstate Corrections Compact Commissioner Denton Darrington.

    b. Request approval pursuant to the State Travel Policy and Procedures to assign a state vehicle to Director Kevin Kempf.

    Discussion: Mr. Benjamin noted that item a. has been approved in the past on an annual basis. Mr. Darrington serves with no compensation, but would like his travel to be reimbursed.

    Mr. Hurst asked how much the fund generates.

    Mr. Twalt said that the fun carries a sizeable balance.

    Ms. Johnson stated that Mr. Darrington’s costs equal between $300-800 per year.

    Regarding item b., Mr. Olsen asked if the director has had a car in the past.

    Mr. Tewalt answered that this is a new director, and he has to be out and visiting sites around the state. He needs a non-descript license plate, which will provide personal security to him.

    Mr. Benjamin noted that in March of last year, the Fugitive Recovery Unit needed non-descript assigned vehicles for security purposes too.

    Mr. Tewalt said that their whole fleet is unmarked.

    INFORMATIONAL AGENDA

    4. Office of the Attorney General
    a. Notification that Anthony M. Valdez of the firm of Valdez Law Office, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho , Industrial Special Indemnity Fund, in the matter of Stephen D. Talbot.

    b. Notification that J. Kevin West of the firm of Parsons, Behle & Latimer, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing Idaho Department of Correction employee Rona Siegert in the case of Clark v Sandy, et al.

    c. Notification that Keisha L. Oxendine, Prosecuting Attorney with the Shoshone County Prosecutor’s Office, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho in the matter of Linda McCall and Kathy A McClinton revocable living trust real property forfeiture.

    d. Notification that J. Kevin West of the firm of Parsons, Behle & Latimer, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing Idaho Department of Correction employee Rona Siegert in the case of Allison v. Reinke, et al.

    e. Notification that Andrea J. Rosholt of the firm of Moffatt Thomas, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Idaho State Board of Accountancy in the case of Idaho State Board of Accountancy v. Nathan Wendt.
