STATE BOARD OF EXAMINERS
MINUTES – Sub-committee Meeting
July 9, 2013 – 1:30 p.m.
Joe R. Williams Building, 5th Floor Conference Room A

The regular meeting of the Subcommittee to the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 1:30 p.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following members were present: Brian Kane, Office of the Attorney General; David Fulkerson, Division of Financial Management; Betsie Kimbrough, Secretary of State’s Office; and Brian Benjamin, Office of the State Controller, as assisting secretary to the subcommittee.

Also present by invitation were: Jarod Dick, Bureau of Homeland Security; Mary Marsh, Bureau of Homeland Security; Rachelle Vance, Department of Health and Welfare; and Deborah Wonch, Office of the State Controller.
CONSENT AGENDA

1. Minutes
Approval of official minutes for the meeting of the Sub-committee to the Board of Examiners on June 11, 2013.

Resolution: Mr. Kane moved to approve item 1. Ms. Kimbrough seconded the motion. The motion carried on a unanimous voice vote.

    Discussion: Mr. Benjamin explained regarding the first item that there was a jar of mercury the resident had, which broke on the garage floor.

    Ms. Marsh noted that the responsible parties have been billed.

    Resolution: Mr. Kane moved to approve item 2 and place it on the consent agenda. Ms. Kimbrough seconded the motion. The motion carried on a unanimous voice vote.



    3. Ada County Clerk
    Request pursuant to Idaho Code §18-2507, for the prosecution of State Penitentiary inmates in the amount of $1,577.56.

    Resolution: Ms. Kimbrough moved to approve item 3 and place it on the consent agenda. Mr. Kane seconded the motion. The motion carried on a unanimous voice vote.


    4. Department of Health and Welfare
    a. Request that $163,713,300 be transferred from the General Fund to the Cooperative Welfare Fund #0220 during the first quarter of Fiscal Year 2014.

    b. Request that $64,450 be transferred from the Drug Court, Mental Health & Family Court Services Fund #0340 to the Cooperative Welfare Fund #0220 during the first quarter of Fiscal Year 2014.

    Resolution: Mr. Kane move to approve item 4 and place it on the consent agenda. Ms. Kimbrough seconded the motion. The motion carried on a unanimous voice vote.

      5. Office of the Secretary of State
      Request pursuant to Idaho Code 73-212 that the Board approve the annual distribution list for the Idaho Code and its supplements.

      Discussion: Mr. Kane asked if the state pays for the code books given to the counties.

      Mr. Fulkerson commented that the elected officials receive the code books for free, but other agencies and counties are required to pay for them.

      Resolution: Mr. Kane moved to approve item 5 and place it on the consent agenda. Ms. Kimbrough seconded the motion. The motion carried on a unanimous voice vote.

        INFORMATIONAL AGENDA

        6. Office of the Attorney General
        a. Notification that R. David Butler II of the firm of Butler & Looney, P.C. in Vale, Oregon, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Department of Health and Welfare, in the case of the Estate of Mary Thiel.

        b. Notification that Eric T. Green of the firm of Munck Wilson Mandala, LLP, in Dallas, Texas, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, in the case of State of Idaho v. United States of America.

        c. Notification that Anthony M. Valdez of the firm of Valdez Law Office, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Mary Thompson.

        d. Notification that M. Jay Meyers of the firm of Meyers Law Office, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Christopher Nelson.

        e. Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Jerry R. Spanbauer.

        f. Notification that Daniel A. Miller of the firm of Ludwig Shoufler Miller Johnson, LLP, has been appointed pursuant to Idaho Code §67-1409 as Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund, in the matter of Jeffrey E. Shay.
