STATE BOARD OF EXAMINERS
MINUTES – Subcommittee Meeting
October 10, 2017 – 1:30 p.m.
Joe R. Williams Building, 5th Floor Conference Room A

The regular meeting of the Subcommittee to the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 1:30p.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following members were present: Chairman David Fulkerson, Division of Financial Management; Tim Hurst, Office of the Secretary of State; Brian Kane, Office of the Attorney General; and Brian Benjamin, Office of the State Controller, as assisting secretary to the subcommittee.

Also present were Wayne Harris, Idaho Office of Emergency Management; Renee Holt, State Controller’s Office and Jackie McCleve State Controller’s Office.

CONSENT AGENDA

1. Minutes
    Approval of official minutes for the meeting of the Subcommittee to the Board of Examiners on September 12, 2017.

    Resolution: Mr. Kane moved to place item 1 on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

    Resolution: Mr. Kane moved to place item 2 on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

    Discussion:
    Mr. Hurst asked if the first concern was about gas and oil that got into the water or was it the nitrate?
    Mr. Harris responded that initially it was their main concern; however once they got there; they realized the problem was bigger than that.
    Mr. Fulkerson then asked if we were able to get a responsible party to bill.
    Mr. Harris replied that they were able to get everything that they needed.

3. Department of Administration Division of Public Works
    a) Request for recognition of assignment from the State of Idaho, Board of Land Commissioners to OLHF Ada 3, LLC for the real property lease through the Idaho Endowment Fund Investment Board and the Idaho State Public Defense Commission, for occupancy of 816 West Bannock St, Ste. 301 Boise Idaho.

    b) Request for recognition of assignment from the State of Idaho, Board of Land Commissioners to OLHF Ada 3, LLC for the real property lease through the Idaho State Public Defense Commission, for occupancy of 816 West Bannock St, Ste. 201 and 208, Boise Idaho.

    c) Request for recognition of assignment from the State of Idaho, Board of Land Commissioners to AGS Properties LLLP for the real property lease through the Idaho Public Utilities Commission, for occupancy of 472 West Washington, Boise Idaho.

    Resolution: Mr. Kane moved to place item 3 on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

4. Military Division
    a) Request for approval of National Guard Reimbursement billing for the quarter ending June 30, 2017, for $161.70. This is the final worker’s compensation payment for National Guard Member Amber McLeod for injury sustained while assigned to the Kanisku Tower Fire in 2015.
    Resolution: Mr. Kane moved to place item 4 on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

5. Office of the State Controller
    Annual moving expense reports by agency during Fiscal Year 2017.
6. Office of the Attorney General
    a) Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Karen Martin, case #2013-030977.

    b) Notification that Dianne L Sweeney of the firm of Pillsbury Winthrop Shaw Pittman, LLP in Palo Alto California, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of providing legal consultation and advice to the Idaho Department of Water resources, Idaho Water Resources Board in the drafting and negotiation of a design, build and operate contract concerning a water system to Mountain Home Air Force base.
