MINUTES – Subcommittee Meeting
December 12, 2017 – 1:30 p.m.
Joe R. Williams Building, 5th Floor Conference Room A

The regular meeting of the Subcommittee to the State Board of Examiners was called to order at 700 West State Street, Boise, Idaho, at 1:31p.m. pursuant to Idaho Code §67-2002 and by order of the chair.

The following members were present: Chairman Jani Revier, Division of Financial Management; Tim Hurst, Office of the Secretary of State; Brian Kane, Office of the Attorney General; and Brian Benjamin, Office of the State Controller, as assisting secretary to the subcommittee.

Also present were Wayne Harris, Idaho Office of Emergency Management; David Fulkerson, Division of Financial Management; Rachelle Vance, Department of Health and Welfare; Amber Duke, State Controller’s Office and Jackie McCleve State Controller’s Office.


CONSENT AGENDA

1. Minutes
    Approval of official minutes for the meeting of the Subcommittee to the Board of Examiners on November 14, 2017.

    Resolution: Mr. Hurst moved to place item 1 on the consent agenda. Mr. Kane seconded the motion. The motion carried on a unanimous voice vote.

Discussion:
Mr. Kane asked if this is a situation where Jerome did not have the ability to take care of it
Mr. Harris responded that Jerome did not have a team so Emergency Management responded to the call.

3. Department of Environmental Quality
a) Request in accordance with Senate Bill 1187, that $428,874.00 be transferred from the Air Quality Permitting Fund #0186 to the Department of Environmental Quality Fund #0225 during the third quarter of Fiscal Year 2018.

b) Request in accordance with Senate Bill 1187, that $4,640,432.00 be transferred from the General Fund to the Department of Environmental Quality Fund #0225 during the third quarter of Fiscal Year 2018.

c) Request in accordance with Senate Bill 1187, that $508,749.00 be transferred from the Public Water System Supervision Fund #0191 to the Department of Environmental Quality Fund #0225 during the third quarter of Fiscal Year 2018.

d) Request in accordance with Senate Bill 1187, that $310,025.00 be transferred from the Water Pollution Control Fund #0200 to the Department of Environmental Quality Fund #0225 during the third quarter of Fiscal Year 2018.


Resolution: Mr. Kane moved to place item 3 on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.
    4. Department of Health and Welfare
    a) Request that $172,899,500 be transferred from the General Fund to the Cooperative Welfare Fund #0220 during the 3rd Quarter of Fiscal Year 2018 in accordance with appropriations passed.

    Resolution: Mr. Kane moved to place item 4 on the consent agenda. Mr. Hurst seconded the motion. The motion carried on a unanimous voice vote.

      5. Office of the Attorney General
      a) Notification that Paul J. Augustine of the firm of Augustine Law Offices, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Ben Solom, IC Case #2015-005542.

      b) Notification that Daniel A Miller of the firm of Ludwig, Shoufler, Miller & Johnson, LLP, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Guadalupe Lopez, IC #15-005194.


      c) Notification that Dennis P Wilkinson of the firm of Thompson, Smith, Woolf, Anderson, Wilkinson & Birch, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Idaho Transportation Department in any appeal from a hearing officer’s decision filed pursuant to the authority of Idaho Code §18-8002A, Automatic License Suspension Program. Appointment effective January 1, 2018 through December 31, 2018.

      d) Notification that Timothy J Stover of the firm of Worst, Fitzgerals, & Stover, PLLC, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Idaho Transportation Department in any appeal from a hearing officer’s decision filed pursuant to the authority of Idaho Code §18-8002A, Automatic License Suspension Program. Appointment effective January 1, 2018 through December 31, 2018.

      e) Notification that Susan K. Servick, Attorney at Law, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Idaho Transportation Department in any appeal from a hearing officer’s decision filed pursuant to the authority of Idaho Code §18-8002A, Automatic License Suspension Program. Appointment effective January 1, 2018 through December 31, 2018.

      f) Notification that Stephen J Muhonen of the firm of Racine, Olson, Nye, Budge & Bailey, Chtd, has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Idaho Transportation Department in any appeal from a hearing officer’s decision filed pursuant to the authority of Idaho Code §18-8002A, Automatic License Suspension Program. Appointment effective January 1, 2018 through December 31, 2018.
