Subject:Coding Information for Family Medical Leave

As many of you know, on January 28, 2008, President Bush signed into law the National Defense Authorization Act for Fiscal Year 2008 (H.R. 4986) providing two new types of leave to employees with family members serving in the military. On November 17, 2008, the U.S. Department of Labor issued the final FMLA regulations which become effective today, January 16, 2009.

The Division of Statewide Payroll has updated the payroll system with additional earnings codes associated with the new FMLA regulations. These new earnings codes are as follows:

The “Qualifying Exigency” (QE) Leave
    QE leave provides up to 12 weeks (480 hours) of unpaid leave because of any “qualifying exigency” arising out of the fact that a covered employee’s spouse, child or parent is on active duty, has been notified of an impending call to active duty, in support of a contingency operation.
    Employees using QE Leave will code the existing FMLA earnings codes on their time sheets:
      • FMS – Family Medical (Sick)
      • FMV – Family Medical (Vacation)
      • FML – Family Medical (Leave Without Pay)

Service Member Leave
    Service Member Leave provides up to 26 weeks (1,040 hours) of unpaid leave to care for a spouse, child, parent or next of kin who is a covered service member with an injury or illness incurred in the line of duty.
    Employees using Service Member Leave will code the new FMLA earnings codes listed below on their time sheets:
      • FSS – Service Member Leave (Sick)
      • FSV – Service Member Leave (Vacation)
      • FSL – Service Member Leave (Leave Without Pay)
The Division of Human Resources has revised the FMLA Statewide Policy to include eligibility requirements and other pertinent information.
