Subject:Procedure to add Credited State Service hours (Federal Military Deployment)

Per the Uniformed Services Employment and Re-employment Rights Act (USERRA), upon returning to state employment, employees discharged from ‘federal military deployment’ are to receive all employment benefits as if they had been continuously employed. Including, Credited State Service (CSS) hours for the number of regularly-scheduled hours missed during the deployment period. In addition, these hours count as hours worked when determining FMLA eligibility. The Division of Statewide Payroll has established a new procedure for adding CSS hours to an employee’s record for this reason.

Beginning February 8, 2009, agencies will use the processing instructions below when adding ‘federal military deployment’ CSS hours to an employee’s record:
    • IPOPS personnel change – Change reason ‘AM – Return from Military Duty’ must be processed prior to adding ‘federal military deployment’ CSS hours
    • IPOPS payroll ‘MVA Adjustment’ – Used to submit information to DSP
        Earnings Code ‘MDS – Military Deployed Service’ – New earnings to be used only for adding ‘federal military deployment’ CSS hours

        Number of CSS hours – Enter the number of CSS hours to be added to the employee’s record. These hours will be added to both statewide and agency credited state service hours. In addition, these hours will be counted as hours worked when determining FMLA eligibility

        Remarks required – Provide the following information in the ‘remarks’ area’ of the MVA adjustment action (explains why the action is necessary):
          PCN
          Dates of ‘federal’ deployment
          Total # of MDS hours to be added
          Number of hours per pay period during the deployment period

      Example of ‘Remarks’ information:
      PCN: 9999
      Employee was on Federal Active Duty: 1/04/08 to 2/16/08
      MDS hours to be added: 200.0

      Pay Period #08002 (12/30/07 – 01/12/08): 0 hours, used paid leave
      Pay Period #08003 (01/13/08 – 01/26/08): 80 hours
      Pay Period #08004 (01/27/08 – 02/09/08): 80 hours
      Pay Period #08005 (02/10/08 – 02/23/08): 40 hours
