Subject:Scheduled deletion of comp time balances for Executive employees

SB1363 (IC 67-5328) states:

FLSA Executive employees as of June 18, 2006
    • Employees with comp time balances of 240 hours or less have until December 31, 2006 to use it or lose it. Our office will programmatically remove the comp time balances January 19, 2007.
    • Employees with comp time balances more than 240 hours have until December 31, 2008 to use it or lose it.

03/26/2007 Senate Concurrent Resolution No.120 did not adopt the following Temporary Rule

DHR Rule 260.03 states:

Employees promoted, reappointed, etc. as FLSA Executive employees after June 18, 2006
    • Employees with comp time balances (regardless of the size of the balance) have six months from the date of appointment to deplete their comp time balance.
      NOTE: At this time, SCO will not automatically delete the comp time balances of these employees. It is to be administered by the individual agency. However, future legislation changes may modify this process. SCO can run informational IBIS reports for the agency if requested.
          To avoid manually administering these balances, an agency may go before the Board of Examiners and request a payoff of comp time balances prior to the employee being moved to the Executive status. However, no expectations by the agency or the employee should be made prior to the decision being rendered by the board.
