Hours of Service - Affordable Care Act

Hours of Service is defined as each hour which an employee is paid, or entitled to payment. This also includes vacation, holidays, illness, incapacity (including disability), layoff, jury duty, military duty or Family Medical Leave (FMLA).

Exemptions to Hours of Service:

Work-Study Program – Hours of service do not include any hour for services that are performed as part of a Federal Work Study Program or a substantially similar program of a state.   

Bona Fide Volunteer - A volunteer who does not receive (and is not entitled to receive) compensation in exchange for the performance of services are not treated as hours of service.

Leave Without Pay - Time coded as leave without pay is not considered hours of service (this does not include FMLA). Therefore, if an employee is gone for an extended period of time and it is not covered under FMLA, they may be subject to a break in service.
